with us Tuesday, June 9th at 9:00 AM, 5th floor at the Board of Supervisors meeting - County Building.
 ALERT:  ATTEND THE BOARD OF SUPERVISORS JUNE 2nd meeting at 9am, 5th floor, County Building for agenda item #12.  The BOS led by Ellen Pirie and Neil Coonerty along with Susan Mauriello, CAO and Dana McRae, County Counsel, want to pass on the consent agenda item #12 (without your input to correct the unlawfulness) the disbanding of the Building and Fire Code Board of Appeals Commission.  They cannot per Health and Safety Code 17920.5 as a legitimate sitting board existed and was faithfully discharging their duties according to higher statutes.  Please attend and protest that they cannot pass these unlawful amendments and also their amendments are not law for 90 days and they are not law unless certified by the State first and published if relating to the Uniform California Building Codes that this Appeals Board does.  The State must certified and publish any new laws in their 2010 edition to be new law.  The County has no findings to justify their removal and assault on our civil rights and property rights.  The Building and Fire Code Board of Appeals Commission is a legitimate entity and still exists in our investigations.

The Supervisors, led by Ellen "Property Pirate" Pirie and Neil "Con" Coonerty, are still violating higher statutes and breaching their mandatory duties to allow the Building and Fire Code Board of Appeals Commission to be independent and with powers authorized by the State that would give them the right to reverse County codes, planning dept. errors & omissions, and misinterpretation of law by the CAO & County Counsel, Dana McRae and Rahn Garcia.
Please read the agenda items to be addressed at the next meeting coming up.  Many are not in compliance with higher laws and your Constitutional rights.
Property owners are protesting excessive fees, unlawful charges/liens, unlawfully placed red tag harassment and corrupt supervisors covering up planning dept. extortion practices they have designed in unfair and illegal ordinances. Stand up! Arrive early to locate parking.


Planning Dept. Director and staff are NOT certified as required by state law. Check www.ICCsafe.com for yourself.  Tom Burns, the Building Official is not certified and none of the staff planners and code staff are.  The Civil Service Commission is mislead by Personnel Dept. Mike McDougall and Laurie Hill who are using retired or transferred staff certificates as 'cover'.

Protest Jan. 27th at 9AM open mic at the Board of Supervisors over unlawful planning dept. practices and illegal Supervisor ordinances removing our rights, liberties and freedoms.
Please protest the Supervisors denial of due process in the planning dept. by their passage Nov. 25th of agenda item 9.1 eliminating the state mandated California Building Code 108.8 that allows for independent appeals for any adverse planning dept. decision, order or determination.  Only 28 housing permits were give in 2008.  Please protest the Supervisors continual imposing of illegal 911 fee charges on phone bills and their illegal "Other Taxes" on real estate tax bills. They have again breached their oaths of office.   Please come early to find parking. 

November 25, 2008 protest regarding deletion of unlawful wording must be achieved.  The wording in a new proposed  Ordinance to amend sections 2.38, 12.10 and 12.12 to delete State mandated California Building Code 108.8 in its entirety and to ignore State mandated International Building Code and Uniform Housing code language for appeals to appeals board for any reason without restriction is unlawful. Read the proposed Consent Agenda 9.1 unlawful document that must be voided.

We want to fill the room with unhappy homeowners and contractors who want change and who want their rightful Building and Housing Appeals Boards that were deleted and hidden by all sections of this County operating government since 1976.  The appeals board powers have been eliminated violating State legal requirements and precedent case law per Briseno v. City of Santa Ana - counties cannot narrow (alter) state laws and codes.  Protest for the Supervisors to recuse themselves from the appeal board process completely.  Stop the appointment of puppet appeal board persons.  Fight for the State mandated full powers to be returned to the appeals boards to hear "any adverse determination" and to "reduce unreasonable fee" demands made by the planning dept/code compliance. Please protest with us Sept. 9th, 9AM, 5th floor, Supervisors meeting County Building.
Please arrive early to find parking.  We will be protesting continued manipulation of property rights and uncover more conflict of interest abuses and violations.  Supervisors and Planning are caught again and will be exposed! Criminal conspiracy holds fines and imprisonment penalties. Demand they provide full retribution to property owners, fire those responsible for the cover up of the Building and Housing (two) appeals boards, and make all appeals and hearings FREE. After all, these are only needed to correct their own errors imposed on local citizens and their properties. In addition, permit fees need to be reduced.  We also believe the Supervisors should volunteer for their positions and receive no pay.  Paying them huge salaries has not protected the public.

This item may be commented on at the Public Comment period at the beginning of the agenda (Approximately 9:00) and letters can be delivered or emailed in prior or you can speak as the agenda item #25 is called.
 An alert has prepared under read more below.  All of us have not received proper hearing information and therefore, now have two years of recourse allowed when one realizes their civil rights have been violated.  The Supervisors and County Planning Dept. have not disclosed for approximately 6.5 years an independent hearing board for separation of power. County Code 12.12 delineates the structure and we believe was breached at the July 23, 2008, first nonofficial meeting of the BBAC.  Some of the most outspoken citizens are wondering what Federal Crimes and Violations may have been committed and by whom. Private Planning Against Landlords and Property Owners Meeting by City Council took place yesterday morning at 10AM, Thursday, June 19, 2008.

Please fight this control over landlords, property rights and disregard for State Uniform Housing Codes that override any local ordinance pertaining to this.  Write your objection letters to the Council, Attn:

(Also, properties built prior to 1950 are not under their jurisdiction.  Any property owner who did not receive disclosure of the Building or Housing Board of Appeals Commissions for their appeal hearings has two years for recourse under civil rights protection laws.  Note there was an amnesty for red tags in 1978 or 1980.)

August 10, 2008 -  Please join us Tuesday morning at 9AM at the 5th floor, County Building on  Ocean Avenue to ensure the hidden Building Board of Appeals Commission and the Housing Board of Appeals Commission are established according to State law.  The County Board of Supervisors and Planning Department have hidden these citizen balance of power entities since 1956 and due to citizen protest are now forced to obey the law.  They may be personally liable for not disclosing these required relief boards and proper due process to the public violating their civil rights.  No appeals had been requested as citizens had never heard  and were never notified of the appeal boards. The appeals that were filed through the years were censored and denied by Tom Burns, David Lee, Jennifer Hutchinson, Ellen Pirie, Jan Beautz and others.  This is not the end of this matter by far.

August 5, 2008 -We were able to get the County Counsel, Dana McRae, to admit that the 6.5 year old Building Board of Appeals Commission (BBAC) appointees were not legally active.  Their terms had expired.  The Supervisors, through Ellen Pirie, Chair, tried to use the excuse that no appeals were requested and that is why the BBAC never held a meeting since inception. Local constitution rights activist, Gary Arnold, protested the true facts that the County Supervisors and Planning Department personnel have "hidden" the BBAC from the public and have violated their civil rights and amongst other very serious abuses.  How could anyone appeal when they were never notified of their right to appeal boards?

Please attend these Supervisors Agenda meetings to ensure that no conflict of interest persons are appointed to the available seat(s) for the formerly hidden Building Board of Appeals Commission (BBAC) .  We are concerned about particular applicants that have no experience with constitutional law or the State Building and Housing Codes, or Health and Safety codes, that are being considered. We additionally question some of the current appointees' backgrounds and why they are continued in their seats after 6.5 years of absence. The State Code Section 108.8.3 specifically requires citizens knowledgeable in the California Building Standards Codes and applicable local ordinances.
The Board is receiving applications for those who want to be on the volunteer BBAC and who are qualified.  Please apply under "Commissions" on the County website system if you have the above experience or have been abused by the Planning Dept. or been red tagged so that you have some background of the lack of due process for appeals and hearings.  A dozen citizens attended today's unofficial meeting and none were ever advised that the BBAC even existed and the other required citizen appeal board, (the Housing Appeals Board)is still not existent.
The current appointees are Michael Bethke, Daniel Bronson, Michael Bush (a former Planning Dept. employee - this gives us great concern), John Ferreira (Fire Chief), Joseph Quigg - absent (with a history that concerns us).  County Staff attending the meeting were David Lee, Assistant Planning Director and Jennifer Hutchinson, Building Secretary and another staffer.  According to Code 12.12, the correct Building Secretary should have been Shaun Levingston, Building Inspection Chief, not Hutchinson.  The Alliance for Change will investigate Levingston's history to see if public confidence can or cannot be restored, with him becoming the Board Secretary.
David Lee stated, "This is a joint board that hears building and fire codes according to law."  We question this statement, as according to law everyone has the right to be heard for any reason, yet Lee has been hiding the BBAC from the public or denying access, along with everyone else at the County.  Code 12.12 and State Statute 108.8 do not allow for this.  The BBAC is supposed to be a independent board guaranteeing a separation of power from the County.  This would protect property owners from County government abuses, including improperly used red tag system, misuse of discretionary permits, fraudulent hourly billing and dishonoring 30 day deemed complete applications. The Planning Department and the Supervisors themselves do not understand the superseding laws and Constitutional rights.  How can David Lee understand them when he is viewed sitting at Supervisor Board meetings going along with the improper votes and illegal passage of ordinances or rewording current statutes to their own advantage?  County Counsel does not inform at these meetings when laws are violated either.  A growing group of citizens is finally challenging the long history of wrong doings.
Chief Ferreira stated, "Some items are difficult to adjudicate and this board can hopefully resolve some of those issues." 
After Hutchinson and Lee have for many years not been forwarding any appeals to the BBAC that is required by State law, we are not wondering why no BBAC meeting has ever taken place; it's obvious why.  We are also aware of property owners' appeals to the BBAC being denied by misinformed County staffers, including David Lee's many false statements made at the BBAC meeting today, denying people due process and denying breach of the Brown Act.  We believe David Lee has considerable conflict of interest and the Code does not require the presence of the Assistant Director.  Would property owners feel separation of power with Lee and Hutchinson at the table?
We are not sure if appropriate conflict free persons will be appointed and question the ones from the past with County or City contracts.  Why haven't they stood up for the BBAC to be available all these years?  Will true liberty and rights prevail?  It is up to the public to stand together and protect our rights.  See you August 5th, 19th and 26th.
