June 9, 2009- Board of Supervisors Ax Newly Appointed Building and Fire Code Board of Appeals Commission and Insert Selves Unlawfully.
Government code 1099 does not allow dual seats and the first seat must be forfeited. The Board of Supervisors must now resign to take appeals board unpaid seats they absconded with. In addition, the Supervisors have ignored Dana McRae, head county counsel, legal advise given on August 19, 2008, read transcript of her advise. The BAFCAB was functioning carefully and lawfully amongst tremendous interference, entrapment, slander and libel by County staff, County Counsel, CAO and the Board of Supervisors led by Ellen Pirie and Neil Coonerty. The County has concealed an independent appeals board from the citizens since April 20, 1976, and now have removed the powers and independence guaranteed citizens by civil rights statutes and higher statutes that preempt this arbitrary and capricious action. April 21, 2009, Board of Supervisors public meeting -
HAS THE BOARD OF SUPERVISORS BEEN CAUGHT DRAFTING A FREEZE ON PERMITS FOR A MAJOR LAND TAKING? WHY ARE THEY OVERCHARGING AND MISCHARGING CITIZENS FOR APPEALS AND PERMITS?
Per Government Code 669.5 and other laws, the county bears the "burden of proof" regarding grounds for violations, limiting permits or developments, per land use consultant, Claire Machado. The county has been pursuing the possibility of declaring vacant land/lots as "open space" in a one fell swoop land taking effort against citizens' Constitutional property rights that are also protected by several landmark precedent setting court cases. There already exists a shortage of housing, a shortage of low income housing and then only infill projects would be possible. Government Code 65913 declares current housing shortages. The Board of Supervisors entertaining such an open space ordinance and automatic rezoning of vacant land is unlawful and an aggressive act of collectivism against property owners.
Since June 2008, Cove Britton of Matson Britton Architects, has been requesting the county to explain and substantiate their excessive permit fees and appeal fee pricing and why the fees are not uniform and equal, as required by law. In addition, the county Supervisors have been receiving and allowing unexpected profits to be directed into the general fund rather than returned to reduce fees from the department source of the profits. Several government codes and precedent setting court cases protect against these activities that some would name "fraudulent" diversion of fees.

December 9, 2008 - County still collecting illegal 911 tax on phone bills. Listen to two protest speeches objecting to such unlawful behavior. Harold Griffith, paralegal, has filed a suit for such deliberate indifference and breach of Board of Supervisors' oaths and appellate court rulings. Listen to 9AM Item 5.

County only approves 28 housing permits in 2008 - far below State growth goal of 1.3% of population base. Gordon Stewart, long time property and constitutional rights activist, was able to get Tom Burns, Planning Director to admit he only approved 28 housing permits in 2008! Listen to Item #52.

November 25 and November 18, 2008 - Supervisors Violate State Mandated California Building Code 108.8 in amendment to Ordinance Title 12 regarding appeals boards.
Originally set up to automatically pass as consent agenda items #31 and #32, Alliance for Change and government watchdogs challenged the Board of Supervisors to uphold higher preemptive State mandated California Building Code 108.8 to establish the citizen appeals boards to hear any appeal for "any decision, order or determination" adversely affecting them. Instead, the County Board of Supervisors in alleged collusion with County Administrator, Susan Mauriello, Tom Burns, Planning Director and County Counsel, have unlawfully deleted the entire CBC 108.8 on November 25, 2008. Lawsuits are being filed to hold these officials accountable for breaking the law since 1976.

October 7, 2008 - Supervisors Caught Again Attempting to Re-Appoint appeals board expired persons who did nothing for almost 7 years. Appeals have been blocked and public uninformed of civil right to appeal board due process. Alliance for Change after months of protest were able to reopen for applications and were promised advertising for the seats that has not taken place according to obligations to the public. Dana McRae, County Counsel, tries to justify no advertising. What kind of government doesn't want to serve the people? What is their underlying intention? Listen by selecting items 51 and 52. September 23, 2008 - County Practices and Board defiant actions protested heavily at this Supervisors meeting. Susan Mauriello, County Administrator, writes a Grand Jury Supervisor Response Report without findings and numerous misleading and questionable statements per Alliance for Change citizen protests. Appeal board ghosts renominated by Ellen Pirie, Chair Supervisor who hid the appeals boards since the State mandated them January 1, 2002. Appeal boards have been required since 1956 and property owners have been obstructed by Tom Burns, Director, and his planning department. Listen to item #26 and #27.
Status Report on County Code Land Use Regulations does not tell the whole story of outdated and in conflict with higher laws the county codes are, faulty wording attempting to assign enforceability and legal validity of codes on web host for the codes on line were challenged and words removed, requests that the appeal boards are not obviously accessible on the website nor worded within State statute mandates and other issues have been continued until November 18, 2008, Board of Supervisors meeting. Board of Supervisors Caught Trying to Minimize and Illegally Reconstitute Non-Existent Citizen Board of Appeals
August 5, 2008 - Listen to Item #30 transferred to Item 52a. Local property rights activists protest to protect everyone's rights to due process. Jan Beautz fumbles in not understanding why the boards have not met. They have not met because the County has obstructed appeal applications and never allowed an appeals board to meet! These are extreme violations of civil rights. Listen to Ellen Pirie, Chair Supervisor, make very serious false statements. The Supervisors pretend to be ignorant, however in our experience and opinion, they are orchestrating everything. The FBI and Grand Jury are being requested to investigate the need for restoration of civil rights. This is on the record.

November 20, 2007 - Only a handful of citizens are even aware of the State Mandate requiring local independent appeal boards - plural.
